Terms of Service

By accessing or using Flix Fix (the "Service"), operated by David Nash ("Flix Fix", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the service.

You are responsible for safeguarding the password that you use to access the service and for any activities or actions under your password.

Users Under 13: In accordance with the Children's Online Privacy Protection Act (COPPA), users under the age of 13 must not create an independent account. Access must be provisioned via a guardian-created "Child Account." The parent or legal guardian is fully responsible for all activity conducted under a Child Account.

Flix Fix relies on user-generated ratings and categorizations. You retain ownership of the rating data you submit. We reserve the right to remove any data or account that violates these terms or engages in abusive behavior.

Disclaimer: All movie posters, titles, release dates, overviews, and underlying cinematic data are sourced from The Movie Database (TMDB). We do not claim ownership of this content. TMDB data is provided "as is" and we are not liable for inaccuracies in the underlying movie metadata.

Flix Fix offers a free tier and one or more paid Premium subscription tiers, which may include an optional AI add-on. Premium features, pricing, and any applicable free trial are presented to you at the point of purchase. We describe pricing generically in these Terms; the current prices, plan durations, and trial length are shown in the app or on our website.

• Free trial: If a free trial is offered, unless you cancel before it ends, your subscription will automatically convert to a paid plan and you will be charged the then-current price.
• Auto-renewal: Paid subscriptions renew automatically at the end of each billing period (for example, monthly or annually) until you cancel. By subscribing, you authorize us and our payment processor to charge your payment method on a recurring basis.
• Cancellation: You may cancel at any time through your account settings. Cancellation takes effect at the end of the current billing period, and you retain access to paid features until then.
• Refunds: Except where required by applicable law, payments are non-refundable and we do not provide refunds or credits for partial billing periods or unused features.
• Payments: Billing is processed securely by our payment provider, Stripe. We do not store your full payment card number.
• Taxes: Prices may be exclusive of applicable taxes, which will be added where required.
• Price changes: We may change subscription prices. We will give you advance notice of any price change, and it will take effect on your next billing period after the notice; continued use after that constitutes acceptance.

Flix Fix may offer promotional credits, rewards, referral bonuses, or temporary "day-pass" access to Premium features (for example, through share-to-earn programs). These rewards:

• Have no cash value and cannot be exchanged for money.
• Are non-transferable and may not be sold, traded, or combined except as we expressly allow.
• May expire and may be modified, limited, or discontinued at any time.
• May be revoked, and related accounts suspended, if we reasonably believe they were obtained through abuse, fraud, automated activity, or violation of these Terms.

Our AI advisor ("Flick") and AI-generated recommendations are provided for entertainment purposes only. AI output is generated automatically, may be inaccurate, incomplete, or out of date, and should not be relied upon as professional, legal, medical, financial, or other expert advice. You are responsible for how you use any AI output, and we make no warranty as to its accuracy.

You agree not to misuse the Service. In particular, you may not:

• Scrape, crawl, harvest, or systematically extract data from the Service, or access it through unauthorized automated means.
• Abuse referral, credit, or reward programs, including by creating fake signups or referrals or by manipulating rewards.
• Create accounts through automated means, or register multiple accounts to evade limits, bans, or reward guardrails.
• Interfere with, disrupt, or attempt to gain unauthorized access to the Service, other users' accounts, or our systems.
• Upload unlawful, infringing, harassing, or malicious content, or otherwise violate applicable law or others' rights.

You retain ownership of the content you create on the Service, including your ratings, watchlists, categories, posts, and messages ("User Content"). You are responsible for your User Content and represent that you have the right to share it.

By submitting ratings or other User Content, you grant Flix Fix a worldwide, non-exclusive, royalty-free license to use, host, store, reproduce, and display that content in order to operate, provide, secure, improve, and promote or market the Service — including through third-party social media integrations. This license ends when you delete your User Content or account, except for content already shared with others, retained in backups, or that we must keep to comply with law.

Promotional use — our default is opt-in. Although this license permits both, our product default is that any promotional or marketing use of your content is done on an aggregated or anonymized basis (so you are not personally identifiable). We use identifiable User Content in promotion or marketing only with your opt-in consent, which you may withdraw at any time.

Movie and TV metadata, posters, and images displayed in the Service are provided by The Movie Database (TMDB) and other third-party sources. Our use of the TMDB API complies with the TMDB Developer / API Terms of Use and its attribution requirements, and we redistribute such metadata and images only as those terms permit. This product uses the TMDB API but is not endorsed or certified by TMDB. Where we use other third-party data sources or APIs, we likewise use them in accordance with their applicable terms and attribution requirements.

All Flix Fix trademarks, logos, software, and original content are the property of Flix Fix or its licensors and are protected by intellectual-property laws. You may not copy, modify, or create derivative works from them without permission.

We respect intellectual-property rights and respond to valid notices of alleged copyright infringement under the Digital Millennium Copyright Act (DMCA) and comparable laws. If you believe content on the Service infringes your copyright, send a written takedown request to our designated contact at copyright@flix-fix.com that includes:

• Identification of the copyrighted work you claim has been infringed.
• Identification of the material you claim is infringing and its location on the Service (for example, a URL).
• Your contact information (name, address, email, and phone number).
• A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law.
• A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on its behalf, together with your physical or electronic signature.

We will remove or disable access to material we determine to be infringing and may terminate the accounts of repeat infringers. If you believe your content was removed in error, you may submit a counter-notice to the same contact, and we will handle it in accordance with applicable law.

Flix Fix integrates with, and may let you publish or share to, third-party platforms such as Meta and TikTok. When you use the Service to publish, post, or share content to any third-party platform — and when any automated Flix Fix workflow does so — you and we must comply with that platform's rules, including the Meta Platform Terms, the TikTok Developer Terms of Service, and each platform's Community Guidelines.

Our integrations are built to adhere to those platform policies. You are responsible for ensuring your own use of these integrations complies with the applicable platform terms, and we may suspend or disable an integration or account to maintain compliance.

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Movie and TV metadata and other third-party content are provided "as is" and we are not responsible for their accuracy.

To the fullest extent permitted by law, Flix Fix and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of the Service. Nothing in these Terms limits liability that cannot be limited under applicable law.

These Terms are governed by the laws of the Province of Alberta, Canada, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the courts located there for any dispute arising out of or relating to these Terms or the Service, except where applicable law grants you the right to bring a claim elsewhere.

Termination and Data Deletion

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. You may also request deletion of your account and associated data at any time.

Changes to Terms

We reserve the right to modify or replace these Terms at any time. Material changes will be communicated via the email address associated with your account or a prominent notice on our application.
